The following terms and conditions are a legal agreement between Bold Games, LLC and you ("Partner"). By signing up to be an Partner in the Bold Partner Program ("Program") you agree to be bound by the following terms and conditions. Kindly read them in full before requesting to sign up.
Definitions:
- Agreement - the contract between you and Bold and when signing up to become a Partner and joining the program
- Program - The affiliate program as set out on the website and is bound by this Agreement
- Partner - Party who agrees to the terms of this agreement
- Link - a HTML link that the Partner will receive to link the Affiliate's website to the Site.
1. The Agreement
1.1. A Partner is to provide their full legal name, valid address, e-mail address, PayPal account, and any other requested information truthfully in order to create an Partner account.
1.2. An Partner must provide a valid PayPal address that will be used to receive commission payments.
1.3. Bold Games LLC reserves the right to update and change the Terms from time to time without notice.
1.4. Any changes to the Program shall be subject to these terms.
1.5. The Program shall not be used for any illegal or unauthorized purpose.
Violation of these terms and conditions may result in suspension of your rights to be a Partner and result in lost commissions and/or removal from the Program.
2. Modification of Bold Games Partner program terms and conditions
Bold reserves the right to modify and change the terms of the agreement at any time. It is the responsibility of the affiliate to check back on the terms occasionally. In the event that the affiliate does not accept any changes, the option for the affiliate is to terminate their enrollment in the program.
3. Partner account
In order to enter the Bold Games Partner Program (Hosted by Refersion), the Partner is required to create an account with a login and password. From this Refersion account, the Partner is able to track and view their sales on their own personal dashboard.
4. Accepted methods of advertising
4.1. Partners are permitted to use resources such as links, discount codes, any related banners, and/or text advertisements provided by the Bold Partner program.
4.2. Partners are not permitted to promote any non-affiliate program-related discounts and coupon codes that are found in customer newsletters, the Bold Games website, other third-party websites, and from any source other than directly from the Bold Games Partner program.
4.3. The promotion should include the offer, discount code, link provided by the Bold Games affiliate program and expiration date.
4.4. Partner must remove invalid or expired codes and banners.
4.5. Partner coupon codes and links are not permitted to be promoted on third-party websites such as coupon databases.
4.6. Partners are permitted to promote their coupon code and link on their own social media accounts only. Partners are not permitted to share this information on any Bold Games social pages.
4.7. It is strictly forbidden to use Bold Games trademark along with your partner link on any paid advertising channels.
4.8. Sales that have been generated from improper promotion will result in loss of commission.
4.9. Bold Games reserves the right to take legal action against any affiliate that commits fraud.
4.10. From time to time, affiliate codes may be changed. Partners will be contacted with their new code and all old codes must be removed and replaced with the new discount code.
5. Copyrighted material
The Partner is responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property right, or any other applicable law. Bold Games will not be responsible if a Partner uses another party's copyrighted material in violation of the law.
6. Payments
6.1. Partners receive a commission for sending authorized sales via unique Refersion links provided by Bold Games Program. In order to receive a commission, the referred customer is required to complete their purchase by clicking through the partners link within 30 days of the initial click-through.
6.2. The commission is based only on the product purchased. Payments will be made monthly, on the first of every month (or the next business day thereafter).
6.3. Payout rates may change and they can be viewed by logging into the affiliate's account.
6.4. It is the partner's responsibility to determine if the payout for the link provided has been discontinued.
6.5. As the commission is paid only on links that can be tracked and reported by Bold Games partner program systems, the referred customer must have cookies enabled in order to track the referral.
6.6. Refunded payments are excluded from receiving a commission payment.
6.7. Payments may be revoked in the circumstance that a code is leaked on third-party websites. It is the responsibility of the affiliate to ensure their code is not being exploited outside of their own personal channels.
7. Bold Games Obligations
Bold Games agrees to agree to the following obligations:
7.1. Providing the partner with promotional material and resources, such as links, coupon codes, banners, and any other graphic materials.
7.2. Processing all orders for Bold Games products placed by the partner's link.
7.3. Tracking the sales generated through the partner's link and all social media content via provided tags and mentions.
7.4. Bold Games will provide payment processing, cancellations, returns, and other related customer support for the referred customer's order.
7.5 Provide one new product to the affiliate 2 times per year or every 6 months if needed.
8. Affiliate Obligations
8.1. Partners are requested to post one piece of unique and original content featuring our products on their social media platforms twice a quarter (every 3 months).
8.2. One piece of content can include the following items: Instagram stories (2+ frames), Instagram feed posts, Instagram TV post, Facebook post, Youtube video or post, Tik Tok post, blog post, podcast feature, and any other content approved by Bold Games.
8.3. Instagram content must tag @bold.cards on the photo and in the caption, in addition to the hashtag #boldcards, in order for Bold Gamesto track all content created. Youtube and blog content must link back to the Bold Cards website (www.bold-cards.com).
8.4. Partner must be following @bold-cards.
8.5. Failure to follow Partner obligations may result in Partner content being missed and possible removal from the program.
8.6. Partner removal will take place if partner fail to comply with the content requirements outlined in this agreement.
9. The License
9.1. Bold Games grants to the Partner a non-exclusive, non-transferable, revocable right to access the Bold Games site through the link in accordance with the terms of this agreement and in connection with the promotional materials provided and authorized by Bold Games.
9.2 Bold Games is permitted to use Partner content on social media, website, and, ads. Credit will always be given accordingly.
9.3. Partners are not allowed to modify or change materials provided by Bold Games in any way.
9.4. Both parties agree to not use each other's materials in any manner that is misleading, disparaging, or defaming in any way.
9.5. Inappropriate use of the provided promotional material may be cause for immediate termination of the agreement.
10. Liability
Bold Games will not be liable to the Partner for the defects in the service, interruptions in the accessibility to the service, loss of data on the information handling system or viruses, loss of profits, loss caused by any third party deleting, removing, deactivating or tampering with the Partner tracking service or other consequential loss of whether arising from neglect or breach of contract.
11. Termination
The term of the agreement starts upon Bold Games partner program acceptance of partner's application and can be terminated by either party. Partner can be ended with or without cause at any time, by giving the other party notice of termination in the form of an e-mail. Upon the termination of the agreement, the affiliate will remove all links to theBold Games website, as well as all banners and graphic images provided under the Program.
